Withdrawal from the Contract

If you are a so‑called privileged buyer, i.e.:

A) a consumer, or

B) a natural person for whom the contract concluded with us is directly related to your business activity, but does not have a professional character for you —

as a rule you have the right to withdraw from a distance contract.

You may withdraw from the contract by submitting a declaration of withdrawal, e.g. by email to: sklep@zbylutgaleria.pl.

You may withdraw within 14 days.

The 14‑day withdrawal period begins:
- for a contract under which we deliver goods, being obliged to transfer their ownership – from the moment you or a third party indicated by you (other than the carrier) takes possession of the goods, and in the case of a contract covering multiple goods delivered separately, in batches or in parts – from the moment of taking possession of the last good, batch or part;
- for digital content – from the day the contract is concluded.

To meet the deadline, it is sufficient to send the declaration before it expires.

Return the goods to us without delay to the address: BOGUSŁAW ŻUREK IT&MORE, ul. Zgrupowania AK “Żmija” 13A/5, 01-875, Warszawa, but no later than 14 days from the day you withdrew from the contract.

We will refund payments made by you without delay under the rules set out in the Regulations, but no later than 14 days from the day we receive your withdrawal declaration.

If we have not offered to collect the goods from you ourselves – we may withhold the refund until we receive the goods back or until you provide proof of having sent them back – whichever occurs first.

Remember that the right of withdrawal from a distance contract does not apply, among others, to a contract:
- where the subject of the service is non‑prefabricated goods, manufactured according to your specification or serving your individual needs;
- where the subject of the service is goods liable to deteriorate quickly or having a short shelf life;
- where the subject of the service is goods delivered in a sealed package which, after opening, cannot be returned due to health protection or hygiene reasons, if the package was opened after delivery;
- where the subject of the service is audio or visual recordings or computer software delivered in a sealed package, if the package was opened after delivery;
- for the supply of digital content not supplied on a tangible medium, for which you are obliged to pay the price, if all of the following conditions are met:
   • we have started the service with your explicit prior consent,
   • you were informed before the service began that after its performance you will lose the right to withdraw, and you acknowledged it,
   • we provided you with lawful confirmation of the distance contract including information about the above consent on a durable medium within a reasonable time after the contract was concluded, at the latest before the service began.

Complaints

The following provisions apply to so‑called privileged buyers. If you are not one, please see our Store Regulations for details about complaints.

If we improperly perform the contract concluded with you, you have the right to file a complaint – preferably by email to: sklep@zbylutgaleria.pl or by post to the address ul. Zgrupowania AK "Żmija" 13A/5, 01‑875 Warsaw.

GOODS

As a rule, we are liable for a lack of conformity of goods with the contract, existing at the time of delivery and revealed within two years from that moment.

Under the Consumer Rights Act you may in such a case demand:
a) replacement of the goods, or
b) repair of the goods.

In certain cases you may also:
a) withdraw from the contract, or
b) submit a declaration to reduce the price.

DIGITAL CONTENT

We are liable for a lack of conformity of digital content with the contract, existing at the time of delivery and revealed within two years from that moment.

If the digital content is not in conformity with the contract, you may demand:
a) to bring it into conformity with the contract,

and in some cases you may also submit a declaration to:
b) reduce the price, or
c) withdraw from the contract.
